Coinage Offences.

guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for Life, or for any Term not less than Three Years, or to be im- prisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

XIII. Whosoever shall, with Intent to defraud, tender, atter, or put off as or for any of the Queen's current Gold or Silver Coin,

Medal or Piece of Metal or mixed Metals, resembling in Size, Figure, and Colour the current Coin as or for which the same shall be so tendered, uttered, or put off, such Coin, Meda), or Piece of Metal or mixed Metals so tendered, uttered, or put off being of less Value than the current Coin as or for which the same shall be so tendered, uttored, or put of, shall be guilty of a Misdemeanor, and being convicted thereof shall be liable, at the Discretion of the Court, to be imprisoned for any Term not exceeding One Year, with or without Hard Labour, and with or without Solitary Confinement.

XIV. Whosoever shall falsely make or counterfeit any Coin resembling or apparently intended to resemble or pass for any of the Queen's carrent Copper Coin ; arul whosoever, without lawful Authority or Excuse (the Proof whereof shall lie on the Party accused), shall knowingly make or mend, or begin or proceed to make or mand, or buy or sell, or have in his Custody or Possession, any Instrument, Tool, or Engine adapted and intended for the counterfeiting any of the Queen's carrent Copper Coin; or shall buy, sell, receive, pay or put off, or offer to buy, sell, receive, pay, or put off, any false or counterfeit Coin resembling or apparently intended to resemble or pass for any of the Queen's current Copper Coin, at or for a lower Rate or Value than the same imports or was apparently intended to import, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for any Term not exceeding Seven Years, and not less than Three Years, or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

XV. Whosoever shall tender, utter, or put off any false or counterfeit Coin resembling or apparently intended to resemble or pass for any of the Queen's current Copper Coin, knowing the same to be false or counterfeit, or shall have in his Custody

or Pos- session Three or more Pieces of false or counterfeit Coin re- sembling or apparently intended to resemble or pass for any of the Queen's current Copper Coin, kuowing the same to be false or counterfeit, and with Intent to utter or put off the same or any of them, shall be guilty of a Misdemeanor, and being convicted thereof shall be liable, at the Discretion of the Court, to be im prisoned for any Term not exceeding One Year, with or without Hard Labour, and with or without Solitary Confinement.

XVI. Whosoever shall deface any of the Queen's current Gold, Silver, or Copper Coin, by stamping thereon any Names or Words, whether such Coin shall or shall not be thereby diminished or lightened, shall be guilty of a misdemeanor, and being convicted

XVIII. Whosoever shall make or counterfeit any kind of Coin Counterfeiting not being the Queen's current Gold or Silver Coin, but resembling Foreign Gold or apparently intended to resemble or pass for any Gold or Silver and Silver Coin of any Foreign Prince, State, or Country, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discre- tion of the Court, to be kept in Penal Servitude for any Term not exceeding Seven Years and not less than Three Years, or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Coutinement,

XIX. Whosoever, without lawful Authority or Excuse (the Bringing such Proof whereof shall lie on the Party accused), shall bring or receive into this Colony any such false or counterfeit Coin re- Colony, sembling or apparently intended to resemble or pass for any Gold or Silver Coin of any Foreign Prince, State, or Country, knowing the same to be false or counterfeit, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for any Term not exceeding Seven Years and not less than Three Years,--or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

XX. XXI. Whosoever, having been so convicted as in the last Second preceding Section mentioned, shall afterwards commit the like Offence of Offence of tendering, uttering, or putting off any such false or uttering coun- terfeit Foreign counterfeit Coin as aforesaid, knowing the same to be false or Coin. counterfeit, shall be guilty of a Misdemeanor, and being convicted thereof shall be liable, at the Discretion of the Court, to be im- prisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement; and whosoever, having been so convicted of a Second Offence, shall Third Offence afterwards commit the like Offence of tendering, uttering, or putting off any such false or counterfeit Coin as aforesaid, know- ing the same to be false or counterfeit, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of Kk 4
